1. Introduction & Acceptance of Terms
Welcome to HypeRadar ("we," "our," or "us"). By downloading, installing, or using the HypeRadar mobile application (the "App") and any associated services (collectively, the "Service"), you agree to be bound by these Terms & Conditions ("Terms"). If you do not agree to these Terms, do not use the Service.
We reserve the right to update these Terms at any time. Continued use of the Service after changes constitutes acceptance of the revised Terms.
2. Description of Service
HypeRadar is an AI-powered video analysis platform that helps content creators evaluate their short-form videos. The Service provides:
- AI-generated virality scores (0–100) across multiple categories, for videos you upload and for posts from your connected account
- Detailed analysis of hook quality, content structure, visual quality, audio, and engagement potential
- Connection of a public TikTok or Instagram account, to view its posts with their statistics and analyze them
- An AI-generated account report: your content niche, strengths, weaknesses, and illustrative earnings estimates
- Personalized recommendations and improvement tips
- An AI chat coach for follow-up questions and content strategy guidance
3. Account Registration
Using the Service requires creating an account by signing in with Apple (additional sign-in providers may be offered in the future). Your subscription and analysis history are linked to this account. Some setup steps, such as the initial questionnaire and account report, may be completed before you sign in.
You are responsible for maintaining the confidentiality of your account and for all activities that occur under it. You must be at least 13 years of age (or 16 in certain jurisdictions) to use the Service.
4. Subscription & Payments
HypeRadar is a subscription-based service. Video analysis, the AI chat coach, and account features require an active subscription.
- Plans: Monthly and annual subscription plans are available. Prices are shown in the App before purchase.
- Free Trial: A 3-day free trial is available with the annual plan for eligible new subscribers. Unless you cancel at least 24 hours before the trial ends, the annual subscription begins and your Apple ID is charged automatically.
- Billing: All payments are processed through the Apple App Store. Your subscription automatically renews unless cancelled at least 24 hours before the end of the current billing period.
- Usage Limits: Each subscription includes a monthly allowance of video analysis time, which refreshes every month. Unused monthly allowance does not roll over.
- Cancellation: You may cancel your subscription at any time in your Apple ID subscription settings. Cancellation takes effect at the end of the current billing period.
Refunds are subject to the policies of the Apple App Store.
5. User Content, Video Uploads & Connected Accounts
You retain full ownership of any videos and content you upload to the Service ("User Content"). By uploading User Content, you grant us a limited, non-exclusive license to process, analyze, and store your content solely for the purpose of providing the Service.
When you enter a username or connect a social media account, you confirm that the account is yours or that you are authorized to manage it. The same limited license applies to content imported from that account for analysis. We access only publicly available information and never ask for your social media password. Your use of TikTok or Instagram remains governed by their own terms of service.
You agree not to upload or import content that:
- Infringes on any third party's intellectual property rights
- Contains illegal, harmful, threatening, abusive, or otherwise objectionable material
- Contains malware or any form of malicious code
- Violates any applicable law or regulation
We reserve the right to remove any content that violates these Terms without notice.
6. AI Analysis & Estimates Disclaimer
The virality scores, recommendations, insights, and account reports generated by the Service are AI-produced estimates based on pattern analysis. They are not guarantees of actual video or account performance. Many factors outside the scope of our analysis (timing, algorithm changes, audience behavior, platform policies) affect real-world performance.
Earnings and revenue figures, as well as view and follower projections, shown in the Service are illustrative estimates based on typical creator ranges. They are not predictions, promises, or guarantees of income or growth. Actual creator earnings vary enormously and may be zero.
You should use our analysis as one of many tools in your content creation process, not as a sole determinant of your publishing or business decisions.
7. Intellectual Property
The Service, including its design, features, code, AI models, and branding, is owned by HypeRadar and protected by intellectual property laws. You may not copy, modify, distribute, reverse-engineer, or create derivative works from any part of the Service without our prior written consent.
8. Usage Limits & Fair Use
To maintain service quality for all users, the following fair-use policies apply:
- Each subscription includes a defined monthly allowance of video analysis time.
- Individual videos are limited to 90 seconds for analysis.
- Bulk uploading, automated uploading, or using the Service through unauthorized scripts or bots is prohibited.
- AI chat interactions are subject to usage limits per video and per day.
- We reserve the right to throttle or suspend accounts that engage in abusive usage patterns.
9. Termination
We may suspend or terminate your access to the Service at any time, with or without cause, including for violation of these Terms. Upon termination, your right to use the Service ceases immediately. Provisions that by their nature should survive termination (including ownership, disclaimers, and limitations of liability) shall survive.
10. Limitation of Liability
The Service is provided "as is" and "as available" without warranties of any kind, express or implied. We do not guarantee that the Service will be uninterrupted, error-free, or that the AI analysis will be accurate.
To the maximum extent permitted by law, HypeRadar shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, arising from your use of the Service.
Our total aggregate liability for any claims relating to the Service shall not exceed the amount you paid us in the twelve (12) months preceding the claim.
11. Changes to Terms
We may modify these Terms at any time by posting updated Terms on our website or within the App. We will make reasonable efforts to notify users of material changes. Your continued use of the Service following any changes constitutes acceptance of the new Terms.
12. Governing Law & Disputes
These Terms shall be governed by and construed in accordance with applicable law, without regard to conflict of law principles. Any dispute arising from these Terms or the Service shall first be attempted to be resolved through informal negotiation. If negotiation fails, disputes shall be resolved through binding arbitration in accordance with applicable arbitration rules.
