1. Introduction & Acceptance of Terms
Welcome to HypeRadar ("we," "our," or "us"). By downloading, installing, or using the HypeRadar mobile application (the "App") and any associated services (collectively, the "Service"), you agree to be bound by these Terms & Conditions ("Terms"). If you do not agree to these Terms, do not use the Service.
We reserve the right to update these Terms at any time. Continued use of the Service after changes constitutes acceptance of the revised Terms.
2. Description of Service
HypeRadar is an AI-powered video analysis platform that helps content creators evaluate their short-form videos before publishing. The Service provides:
- AI-generated virality scores (0–100) across multiple categories
- Detailed analysis of hook quality, content structure, visual quality, audio, and engagement potential
- Personalized recommendations and improvement tips
- An AI chat coach for follow-up questions and content strategy guidance
3. Account Registration
You may use the Service with an anonymous account managed through our payment provider, RevenueCat. You may optionally link your account with Apple Sign In or Google Sign In for a personalized experience.
You are responsible for maintaining the confidentiality of your account and for all activities that occur under it. You must be at least 13 years of age (or 16 in certain jurisdictions) to use the Service.
4. Subscription & Payments
HypeRadar offers a subscription-based service with a free trial period:
- Free Trial: New users receive a 3-day free trial with limited analysis time.
- Subscriptions: After the trial, continued access requires a paid subscription (weekly or annual plans available).
- Billing: All payments are processed through the Apple App Store or Google Play Store via RevenueCat. Your subscription automatically renews unless cancelled at least 24 hours before the end of the current billing period.
- Usage Limits: Each subscription tier includes a monthly limit of video analysis seconds. Usage resets at the beginning of each billing cycle.
- Cancellation: You may cancel your subscription at any time through your device's app store settings. Cancellation takes effect at the end of the current billing period.
Refunds are subject to the policies of the Apple App Store or Google Play Store.
5. User Content & Video Uploads
You retain full ownership of any videos and content you upload to the Service ("User Content"). By uploading User Content, you grant us a limited, non-exclusive license to process, analyze, and temporarily store your content solely for the purpose of providing the Service.
You agree not to upload content that:
- Infringes on any third party's intellectual property rights
- Contains illegal, harmful, threatening, abusive, or otherwise objectionable material
- Contains malware or any form of malicious code
- Violates any applicable law or regulation
We reserve the right to remove any content that violates these Terms without notice.
6. AI Analysis Disclaimer
The virality scores, recommendations, and insights generated by the Service are AI-produced estimates based on pattern analysis. They are not guarantees of actual video performance. Many factors outside the scope of our analysis (timing, algorithm changes, audience behavior, platform policies) affect real-world video performance.
You should use our analysis as one of many tools in your content creation process, not as a sole determinant of your publishing decisions.
7. Intellectual Property
The Service, including its design, features, code, AI models, and branding, is owned by HypeRadar and protected by intellectual property laws. You may not copy, modify, distribute, reverse-engineer, or create derivative works from any part of the Service without our prior written consent.
8. Usage Limits & Fair Use
To maintain service quality for all users, the following fair-use policies apply:
- Each subscription tier has a defined monthly limit of video analysis seconds.
- Bulk uploading, automated uploading, or using the Service through unauthorized scripts or bots is prohibited.
- AI chat interactions are subject to reasonable usage limits per analysis session.
- We reserve the right to throttle or suspend accounts that engage in abusive usage patterns.
9. Termination
We may suspend or terminate your access to the Service at any time, with or without cause, including for violation of these Terms. Upon termination, your right to use the Service ceases immediately. Provisions that by their nature should survive termination (including ownership, disclaimers, and limitations of liability) shall survive.
10. Limitation of Liability
The Service is provided "as is" and "as available" without warranties of any kind, express or implied. We do not guarantee that the Service will be uninterrupted, error-free, or that the AI analysis will be accurate.
To the maximum extent permitted by law, HypeRadar shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, arising from your use of the Service.
Our total aggregate liability for any claims relating to the Service shall not exceed the amount you paid us in the twelve (12) months preceding the claim.
11. Changes to Terms
We may modify these Terms at any time by posting updated Terms on our website or within the App. We will make reasonable efforts to notify users of material changes. Your continued use of the Service following any changes constitutes acceptance of the new Terms.
12. Governing Law & Disputes
These Terms shall be governed by and construed in accordance with applicable law, without regard to conflict of law principles. Any dispute arising from these Terms or the Service shall first be attempted to be resolved through informal negotiation. If negotiation fails, disputes shall be resolved through binding arbitration in accordance with applicable arbitration rules.
